INTRODUCTION

Foodlink F&B Holdings (India) Limited (formerly known as Foodlink F&B Holdings (India) Private Limited (herein referred to as the "Company" or "Foodlink" or "Us" and also indicated by "us", "we" or "our") and our affiliated companies, are committed to respecting your online privacy and recognize your need for appropriate protection and management of any personally identifiable information ("Personal Information") you share with us based on applicable data protection laws and regulations (as amended).

This Privacy Policy ("Policy") applies to all visitors, users and others (hereinafter referred to as "You" or the "User") who access or use the (i) Website- Foodlink - Privacy Policy (ii) the social media accounts and/or pages that Foodlink control (Sites/Apps).

Except as otherwise provided in this Policy, in general, you can visit/use our Sites/Apps without identifying who you are. Foodlink will provide you with the option to deal with Foodlink without identifying yourself where it is lawful and practical. However, particular sections on our Sites/Apps may require you to provide personal information in order that we may provide the products/services or information you have requested while visiting/using our Sites/Apps.

This Privacy Policy is intended to inform you know what personal information we collect, why we collect (purpose) and what we do with it (use), processing/sharing and transfer of personal information and your rights relating to such personal information shared with us.

Accordingly, following is our Privacy Policy setting out how We intend to safeguard such sensitive personal data or information received and used by us as aforesaid. This is in compliance with the prevailing Information Technology Act, 2000 and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 made thereunder ("IT Act") and provisions of Digital Personal Data Protection Act, 2023 (DPDP Act).

SCOPE AND APPLICABILITY OF THIS POLICY

This Privacy Policy (the "Policy") as amended from time to time and applies to Foodlink, its affiliates and its subsidiary companies, its employees, staff and team members who collect, possess, use, process, record, store, transfer, disclose, deal, handle and receive, the sensitive personal data or information by and on behalf of Foodlink clients/customers ("Client(s)") including the sensitive personal data or information of the clients/customers of such Clients ("Client Contacts") which has been given to Foodlink by such Clients and/or the Client Contacts ("You" or "Your") while rendering services to them and third parties in India or overseas including but not limited to any consultants, contractors, advisors, accountants, agents, person, representatives of Foodlink and/or service providers etc who provide services to or on Foodlink behalf in connection with its business ("Third Party"). This Policy summarizes what type of Sensitive Personal Data or Information (as defined hereinafter) We collect about You, purpose of collection, storage and usage of such data or information, to whom such data or information may be disclosed/transferred and how We protect Your privacy.

This Policy does not apply to any information that You may disclose publicly, and which is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force and such information shall not be regarded as Sensitive Personal Data or Information for the purposes of this Policy. Further, the Sensitive Personal Data or Information of You shall not be disclosed to any third person unless the said third person is required to have the Sensitive Personal Data or Information of You to provide required services to You and/or with your permission and/or to help investigate, prevent or take action regarding unlawful and illegal activities, suspected fraud, potential threat to the safety or security of any person, violations of www.foodlink.global terms of use or to defend against legal claims and special circumstances such as compliance with the rules of any stock exchange, subpoenas, court orders, requests/order from legal authorities or law enforcement agencies requiring such disclosure. We share your information with advertisers on an aggregate basis only.

TYPES OF INFORMATION OR PERSONAL DATA WE COLLECT

Personal Information (PI):

means any information that identifies you as an individual ('data subject' here in referred as you/your') and any other information we associate with it. In particular using a common identifier this includes but is not limited to first and last name, email address, mailing and residential address, telephone number, title, birth date, gender, occupation, your profession and other information needed to provide a service you have requested.

Sensitive personal Information (SPI):

data or information means personal information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person.

Log information:

Depending upon the Sites/Apps or context, we automatically collect and store certain information that your browser sends whenever you visit our Sites/Apps in server logs ("Log Data").

Information collected through cookies

Social Media Widgets

Our sites and applications may include social media features connected with social media platform such as Facebook, X, Instagram, Thread, Telegram, Snapchat, Google Plus, Pinterest, YouTube and others. These features may collect information about your IP address and which page you are visiting or features you are using and may set a cookie or employ other tracking technologies. Social media features and widgets are either hosted by a third party or hosted directly on our Sites/Apps. Your interactions with those features are governed by the privacy policies of the companies that provide them.

Tracking code in website analytics, a tracking code is a snippet of script that tracks the activity of a website user by collecting data and sending it to the analytics module. The code is generated automatically, is different for each website, and can be installed on each page that needs tracking.

Careers

Our site may include a link to our Career Section. Any Personal Information submitted through that portion of the sites, by upload or via e-mail, will be governed as per this privacy policy.

Most of the Sensitive Personal Data or Information We collect is the data or information that is wilfully and knowingly provided to us by You. However, in some instances, We collect Sensitive Personal Data or Information about You, based on our inferences about You, from other information provided to us by You or on our interactions with You or on such personal information about You that We receive from a third party with Your knowledge.

Third Party Links:

Our Sites/Apps may have links to the websites/Apps of other third parties and these third-party websites/Apps may collect personal information about Users for their own purpose, in such cases, our Privacy Policy does not extend to these external websites/Apps of third parties. Please be aware that if you access these links, you will be leaving our Site(s). We encourage users to read the privacy policies of those websites/apps, as we are not responsible for their content, links, or privacy procedures.

INTERNATIONAL SHARING AND/OR TRANSFERS OF YOUR PERSONAL INFORMATION

Foodlink is a global group and therefore uses global dealers, distributors, vendors, subcontractors and other business partners, as well as global IT systems and applications. We may require the transfer of PI/SPI to other third parties that are located outside of the country of business. We shall develop a standardized approach for protection of data moving across borders. We will adopt appropriate technical and administrative controls that apply well to cross border data flows to act as an accountability framework for information management as a whole and including natural checkpoints for each step of international transfer.

YOUR CONSENT

Once You give Your Consent, it means You have done so freely and voluntarily and agree to this Policy. You always have the right to refuse or withdraw Your Consent for the Sensitive Personal Data or Information sought to be collected or withdraw Your Consent given earlier to us. We will always respect such a refusal or withdrawal, but it might mean that We are unable to perform all services, arrangements or contracts with You and will have the option to discontinue the same. We will inform You of these inabilities, if they occur. However, we reserve the right to retain such Sensitive Personal Data or Information as may be necessary for providing our pending services to You and in accordance with this Policy.

PURPOSES FOR COLLECTION, STORAGE AND/OR USE OF SENSITIVE PERSONAL DATA OR INFORMATION

The primary purposes for collection, storage and/or use of Sensitive Personal Data or Information are for:

  • our business processes, operations and management including but not limited to performance of the business, operation of the services, entering into or performing any contract, maintaining quality of the services, providing support to the Food Items/ products or services You have obtained from us, managing company;
  • processing Your order, corresponding with You, fulfilling Your transaction requests and delivering the programs, Food Items/products, information, and services requested by You or other services related inquiries;
  • managing Client Contacts profiles including but not limited to the business relationship between the Clients and Client Contacts, administering and developing our business relationship with You, providing You with information, Food Items/products or services that You request from us or which We feel may interest You, record keeping and other general administrative and services related processes;
  • ensuring the safety and protection of the rights or property of Foodlink or its business;
  • complying with applicable legal requirements including but not limited to Governmental reporting, etc and fulfilling statutory/legal obligations as a service provider under applicable laws, adhering to judicial or administrative orders, compliance with laws;
  • contacting You via surveys to conduct research about Your opinion of current services or of potential new services that may be offered by us;
  • monitoring or recording of certain calls, chats and other interactions relating to the online transactions which may involve You calling us or us calling You and online chats for staff training or quality assurance purposes or to retain evidence of a particular transaction or interaction;
  • while conducting daily business/operations such Sensitive Personal Data or Information may be provided to affiliates and associate companies, employees/staff of Foodlink and Third Party's for the purpose of processing such Sensitive Personal Data or Information for or on our behalf including but not limited to helping us to perform statistical analysis, send You email or postal mail, provide customer support/support services, arrange for deliveries of Food Items/products, information, and services etc;
  • direct marketing and promotional purposes;
  • operating Website, improving the content of our Website to offer You better food items/products and/or services and to ensure that content from our Website is presented in the most effective manner for You; and
  • in connection with the business of Foodlink.

REASONABLE SECURITY PRACTICES AND PROCEDURES AND AUDITS

We seek to ensure compliance with the requirements of the IT Act to ensure the protection and preservation of Your privacy, therefore We take appropriate security measures to protect Your Sensitive Personal Data or Information against unauthorized access, alteration, disclosure or destruction. We have a number of physical, electronic, and procedural safeguards/measures in place to actively protect the confidentiality, security, and integrity of Your Sensitive Personal Data or Information, including a comprehensively documented information security programme and a strict security policy that contains managerial, technical, operational and physical security control measures for protecting such data or information. We have implemented standard or code of best practices for data or information protection.

We conduct training to authorized users regarding the lawful and intended purposes of processing Your Sensitive Personal Data or Information, the need to protect and keep information accurate and up-to-date and the need to maintain the confidentiality of the data or information to which such authorized users have access. Authorized users will comply with this Policy, and We will take appropriate disciplinary actions, in accordance with applicable laws, if Your Sensitive Personal Data or Information is accessed, processed, or used in any way that is inconsistent with the requirements of this Policy. To further ensure enforcement of this Policy, the standard or code of best practices will be audited for compliance with this Policy and IT Act. For this purpose, we engage an independent auditor duly approved by the Central Government, to conduct the audit at least once a year or when We undertake significant upgradation of our process and computer resources and take such corrective action if necessary to address any issues or problems that such audit reveals.

RETENTION OF YOUR SENSITIVE PERSONAL DATA OR INFORMATION

We are aware of the importance of timely destruction of Sensitive Personal Data or Information. We ensure that Your Sensitive Personal Data or Information is not stored/retained for a longer period than necessary for the purpose for which it was collected, used or processed or as provided in our contracts except when there is a legal obligation to do so under any law. It is our practice to destroy Your Sensitive Personal Data or Information as soon as possible after it is no longer necessary for the purpose for which it was collected, used or processed save and except as stated hereinabove.

ENFORCEMENT OF LEGAL OBLIGATIONS

The User acknowledges that "Foodlink" may terminate the User's account and remove the Content and other Network Data, as well as disable the User's access to any and all Networks at any time for violations of this policy without notice and without any liability to the User. The User is solely responsible and liable for complying with all applicable laws including privacy laws.

The User acknowledges that "Foodlink" may terminate the account of any User in accordance with the terms of this policy.

The User acknowledges that "Foodlink" also reserves the right to remove, preserve, and disclose any information or Content or account it deems necessary or appropriate to (a) satisfy any applicable law, regulation, legal process or governmental request, (b) enforce this policy, including investigation of potential violations hereof, (c) detect, prevent, or otherwise address fraud, security, or technical issues, (d) respond to User support requests, (e) protect the rights, property, or safety of "Foodlink", its Users, and the general public, or (f) investigate or defend ourselves against third-party claims or allegations.

REPRESENTATIONS AND WARRANTIES

The User represents and warrants to "Foodlink" that it is fully able and competent to enter into the terms, conditions, obligations, representations and warranties set forth.

The User represents and warrants to "Foodlink" that the User shall comply with all applicable local, state, national and international laws, rules, and regulations in connection with the User's use of the website.

All other representations and warranties, whether express or implied, are explicitly disclaimed by both Parties hereto.

The User warrants and agrees that, while using the website and the various services and features offered on or through the website, you shall not:

  • impersonate any person or entity or misrepresent your affiliation with any other person or entity
  • insert your own or a third party's advertising, branding or other promotional content into any of the website's content, materials or services, or use, redistribute, republish or exploit such content or service for any further commercial or promotional purposes
  • attempt to gain unauthorized access to other computer systems through the website.

MISCELLANEOUS

This Privacy Policy shall be governed by the laws of India and the courts in Mumbai shall have the exclusive jurisdiction to try any disputes arising thereof. This Privacy Policy shall be governed by any applicable data protection laws.
